Terms of Service

These Terms govern use of T-Shop (formerly All-Track App), provided by Castle One X (“we”). Use of the App constitutes acceptance of these Terms and the Privacy Policy.

1. Service

T-Shop is a user-directed application for checking public content and price information, managing shopping lists, comparing retailers, locating stores, issuing notifications and related functions. Core functions are provided on-device. Checks may be manual or scheduled by the user. Some functions rely on T-Shop or third-party services.

The user selects the content and destinations processed by the App. T-Shop does not host or control third-party websites or their content. Availability varies by device, region, retailer and configuration.

2. Third-Party Data and Transactions

Prices, availability, product matches, package data, branches, distances and totals originate from or depend on third parties and may be inaccurate, incomplete or delayed. Users must verify product, quantity, price and store before purchase.

T-Shop is not a retailer, seller, payment provider, financial adviser or party to any third-party transaction. Third-party terms and policies apply.

3. Location and Permissions

Nearby-store functions may process foreground location following user authorisation. Denial or revocation may restrict location-dependent functions. The App does not use background location for these functions.

4. User Content and Data Licence

Users retain rights in content they provide. Users grant us a worldwide, non-exclusive licence to host, process, reproduce and analyse that content as required to operate, secure, support and improve the service.

We may use aggregated or de-identified service data for analytics, research, benchmarking, product development and commercial purposes, subject to the Privacy Policy.

5. Acceptable Use

Users must not:

• Violate applicable law or third-party rights.
• Violate third-party terms, acceptable-use policies or access rules.
• Disrupt, damage or obtain unauthorised access to systems or services.
• Circumvent security, access controls or legal restrictions.
• Resell, redistribute, reverse engineer or commercially exploit the App except as permitted by law or written authorisation.

Users are responsible for operations initiated through the App. Third parties may restrict or block access to their services. We are not responsible for third-party penalties or access restrictions resulting from user activity.

6. Accounts, Backup and Availability

Users are responsible for account security, device configuration and independent copies of important data. Synchronisation, notifications, backups and historical records may fail, be delayed or become unavailable.

We may suspend access for security, maintenance, legal compliance or misuse.

7. Intellectual Property

The App, underlying technology, interfaces, designs, branding and original content belong to Castle One X or its licensors. Users receive a limited, revocable, non-exclusive and non-transferable personal-use licence. Reverse engineering, modification or unauthorised distribution is prohibited except where applicable law permits it.

8. Disclaimer

The App is provided “as is” and “as available”. To the maximum extent permitted by law, implied warranties of accuracy, availability, merchantability, fitness and non-infringement are excluded. Mandatory consumer rights remain unaffected.

9. Liability

To the maximum extent permitted by law, Castle One X and its affiliates exclude liability for direct, indirect, incidental, special, consequential or punitive loss, including loss of profit, savings, data, opportunity or goodwill; excessive battery, mobile-data or other device-resource consumption; and hardware degradation arising from use or inability to use the App.

Where liability cannot be excluded, aggregate liability is limited to the amount paid for T-Shop during the preceding 12 months, unless applicable law requires otherwise.

10. Indemnity

To the extent permitted by law, users shall indemnify Castle One X against claims, losses, liabilities and reasonable costs arising from their unlawful use of the App, breach of these Terms or infringement of third-party rights.

11. Changes and Termination

We may amend these Terms or modify, restrict, suspend or discontinue the App or any function. Material amendments may require renewed acceptance. Users may stop using the App at any time. Provisions intended to survive termination remain effective.

12. Governing Law

These Terms are governed by the laws of New Zealand. You and Castle One X submit to the non-exclusive jurisdiction of the courts of New Zealand. Nothing in these Terms limits any rights or remedies that cannot lawfully be excluded.
